1. Acknowledgment of Risk

The Participant acknowledges that swimming and the use of the swimming pool facilities carry inherent risks, including but not limited to the risk of drowning, slipping, falling, or suffering other injuries. The Participant understands these risks and agrees to assume full responsibility for any injuries or damages that may occur as a result of participation in swimming pool activities.

2. Release and Waiver

The Participant, on behalf of themselves, their heirs, assigns, and next of kin, hereby releases, waives, and discharges the Pool Owner/Operator, its employees, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by the Participant or to any property belonging to the Participant while using the swimming pool facilities.

3. Indemnification

The Participant agrees to indemnify and hold harmless the Pool Owner/Operator, its employees, agents, and affiliates from and against any and all claims, demands, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, arising out of or related to the Participant’s use of the swimming pool facilities.

4. Medical Treatment

In the event of an emergency, the Participant hereby consents to medical treatment and transportation to obtain treatment if deemed necessary by the Pool Owner/Operator or its representatives. The Participant agrees to be responsible for any medical expenses incurred as a result of such treatment.

 

5. Rules and Regulations

The Participant agrees to adhere to all rules and regulations set forth by the Pool Owner/Operator regarding the use of the swimming pool facilities. The Participant acknowledges that failure to comply with these rules and regulations may result in revocation of pool privileges without refund.

 

6. Photographic Release

The Participant hereby grants the Pool Owner/Operator the right to capture and use photographs, video footage, or other recordings taken during use of the swimming pool facilities for promotional or marketing purposes, without any obligation of compensation.

 

7. Governing Law

This Waiver shall be governed by and construed in accordance with UK law. 

 

8. Severability

If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

 

9. Entire Agreement

This Waiver constitutes the entire agreement between the parties and supersedes any prior agreements or understandings, whether written or oral, regarding the subject matter of this Waiver

Pool Rules 
 

• All children under the age of 8 must be accompanied by an adult in the water (at arm’s length) at all times. No more than two under 8s to each adult.

• Weak and non-swimmers must stay in the shallow end with an adult. We highly recommend weak and non-swimmers wear approved buoyancy devices.

• Diving allowed in the deep end only. 

• Refrain from backward diving, bombing, ducking, somersaults, gymnastics; No acrobatics.

• No running and diving or running and jumping.

• No eating, drinking. No glass in the pool area

• No underwater swimming or hyperventilation

• Anyone under the influence of alcohol or drugs are not allowed to use the facility.

• If a qualified lifeguard is on duty, all instructions given by the lifeguard must be followed at all times.
